By accessing or using the Dog Park Now website (dogparknow.com), mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Dog Park Now Inc.™, a corporation incorporated in Nova Scotia, Canada ("Dog Park Now", "we", "us", or "our").

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Dog Park Now™ is a community-powered platform that provides real-time information about off-leash dog parks in the Halifax Regional Municipality (HRM) and surrounding areas. The Service allows users to:

• View real-time crowd levels and dog counts at off-leash parks

• Submit community check-ins to report current park conditions

• Access park information including locations, hours, and amenities

• Participate in community features and contests

The Service is currently in pre-launch phase. Features described on this website represent planned functionality and may be subject to change.

By using our Service, you agree to:

• Provide accurate information when signing up or submitting check-ins

• Use the Service only for lawful purposes and in accordance with these Terms

• Not submit false, misleading, or harmful check-in reports

• Not attempt to disrupt, damage, or gain unauthorized access to our systems

• Respect the privacy of other users and community members

• Comply with all applicable Canadian federal and provincial laws

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

When you submit a check-in or any other content through our Service ("User Content"), you grant Dog Park Now Inc. a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for the purpose of operating and improving the Service.

You represent that your User Content is accurate to the best of your knowledge and does not violate any third-party rights or applicable laws.

Dog Park Now does not guarantee the accuracy, completeness, or timeliness of community-submitted information. Park conditions reported by users are estimates and should not be relied upon as definitive or official information. Always exercise your own judgment when visiting dog parks.

The Founding Pack Contest ("Contest") is governed by the following terms:

**Eligibility:** Open to residents of Halifax Regional Municipality (HRM), Nova Scotia, Canada who are 18 years of age or older at the time of entry. Employees of Dog Park Now Inc. and their immediate family members are not eligible.

**Entry Period:** The Contest opens on the date of publication and closes at 11:59 PM Atlantic Time on April 30, 2026.

**How to Enter:** To receive one (1) entry, you must: (a) complete the Dog Park Now early access sign-up form at forms.gle/TGmzyDqaeVUT6ubbA, AND (b) join the Dog Park Now Facebook Group at facebook.com/groups/1417129396795987. Bonus entry: Share the Dog Park Now website on Facebook and tag @DogParkNow for one (1) additional entry. Limit of two (2) entries per person.

**Prize:** Twenty-five (25) winners will each receive one (1) lifetime membership to the Dog Park Now app, providing free access to all standard app features for the lifetime of the app. The lifetime membership is non-transferable, has no cash value, and is subject to the continued operation of the Dog Park Now app and Service.

**Draw:** Winners will be selected by random draw from all eligible entries on or about April 30, 2026. Winners will be notified by email within 7 business days of the draw. If a winner does not respond within 14 days of notification, the prize may be forfeited and an alternate winner selected.

**Personal Information:** Personal information collected for Contest administration is governed by our Privacy Policy and protected under PIPEDA. Information will not be used for any purpose other than Contest administration and Service notifications (with consent).

**General:** Dog Park Now Inc. reserves the right to cancel, modify, or suspend the Contest at any time for any reason. All decisions of Dog Park Now Inc. regarding the Contest are final. The Contest is subject to all applicable federal and provincial laws.

All content on the Dog Park Now website and app, including but not limited to text, graphics, logos, images, and software, is the property of Dog Park Now Inc. or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

"Dog Park Now"™ and "Know Before You Go"™ are trademarks of Dog Park Now Inc. (trademark applications pending). You may not use these marks without our prior written consent.

You may not reproduce, distribute, modify, or create derivative works from our content without express written permission from Dog Park Now Inc.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, DOG PARK NOW INC. DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure

• Community-submitted park information will be accurate or current

• The Service will meet your specific requirements

Park conditions, dog counts, and crowd levels are community-reported estimates. Dog Park Now Inc. is not responsible for decisions made based on this information.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, DOG PARK NOW INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Reliance on inaccurate or outdated park condition information

• Any incidents occurring at dog parks visited based on our Service

• Loss of data or unauthorized access to your account

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim (or CAD $50 if you have not made any payments).

Nothing in these Terms limits our liability for fraud, gross negligence, or any other liability that cannot be excluded under applicable Canadian law.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and protect your personal information in compliance with Canada's PIPEDA legislation.

By using the Service, you consent to the collection and use of your personal information as described in our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Halifax, Nova Scotia, Canada. You consent to the exclusive jurisdiction of such courts.
